1. Scope of Application
These General Terms and Conditions (GTC) apply to all services and offers provided by Die Stilkonsulentin, in particular Personal Shopping, wardrobe updates, style consultations and the sale of gift vouchers.
By booking a service or purchasing a gift voucher, the customer accepts these GTC.
Any deviating agreements shall only be binding if expressly confirmed by Die Stilkonsulentin.
2. Offer and Conclusion of Contract
The services and prices displayed on the website constitute an offer; however, they are non-binding and may be adjusted at any time.
A contract is concluded once a booking has been confirmed via the designated booking system, by email or by another agreed means.
When booking via an online booking system, the customer will receive an electronic booking confirmation.
The prices and conditions published at the time of booking shall apply to the respective service booked.
3. Services
The specific services provided are determined by the respective description on the website, the booking confirmation or an individual agreement.
Die Stilkonsulentin provides its services personally and individually. The nature and scope of the consultation are tailored to the customer's needs, wishes and budget.
Personal Shopping and similar services consist of personal recommendations and consulting services. There is no entitlement to the purchase of specific items of clothing, brands or products.
Die Stilkonsulentin is obliged to provide professional advice, but does not guarantee any particular personal, aesthetic or financial outcome.
4. Appointment Scheduling
Appointments may be scheduled via the booking system integrated into the website, by email or by individual arrangement.
An appointment shall be considered binding once it has been confirmed accordingly.
The customer is responsible for providing accurate contact details when making a booking.
5. Prices and Payment Terms
The prices stated at the time of booking shall apply.
Unless otherwise agreed, invoices must be paid in full within the payment period stated on the invoice, without deduction.
For home visits, additional travel and transportation costs will be charged. The amount depends on the location and the associated effort and will be determined individually and communicated in advance.
In the event of late payment, Die Stilkonsulentin may withhold any outstanding services until the outstanding amount has been paid in full.
6. Cancellation and Rescheduling of Appointments
Agreed appointments are binding.
Cancellation or rescheduling free of charge is possible up to 48 hours before the agreed appointment.
If an appointment is cancelled or rescheduled less than 48 hours before the appointment, 50% of the agreed fee may be charged.
If an appointment is cancelled within 24 hours of the scheduled time or if the customer fails to attend, the full agreed fee may be charged.
If an appointment cannot be attended due to special circumstances, in particular illness or force majeure, both parties shall endeavour to find a reasonable alternative arrangement.
The customer shall remain entitled to provide evidence that no loss or substantially lower loss has occurred.
7. Delay
If the customer is late, the agreed consultation time may be reduced accordingly. The agreed fee shall generally remain unchanged.
In the event of a significant delay, Die Stilkonsulentin may treat the appointment as a no-show. In such cases, the provisions of Section 6 shall apply.
Any delays on the part of Die Stilkonsulentin will be communicated as soon as possible and, where necessary, compensated by extending the appointment accordingly or by another appropriate solution.
8. Personal Shopping and Purchases
During a Personal Shopping session, Die Stilkonsulentin accompanies and advises the customer in selecting clothing, accessories and other products.
The purchase contracts for the selected products are concluded exclusively between the customer and the respective retailer.
Die Stilkonsulentin is not a party to these purchase contracts and assumes no responsibility in particular for:
- the condition or quality of the purchased products;
- availability or delivery times;
- price changes;
- the respective retailer's return, exchange or warranty conditions.
The respective retailer is generally responsible for returns, exchanges and warranty claims.
9. Individual Style Consultation
The style consultation is based on the customer's personal information, wishes and needs.
Recommendations regarding colours, cuts, materials, brands, combinations or shopping strategies constitute personal consulting recommendations.
The customer independently decides which recommendations to implement and which products to purchase.
Die Stilkonsulentin does not guarantee any particular aesthetic, personal or financial outcome of the consultation.
10. Gift Vouchers
Gift vouchers issued by Die Stilkonsulentin may be redeemed for the services specified on the respective voucher.
The voucher is non-transferable unless otherwise agreed.
Cash payment of the voucher value is generally excluded.
Gift vouchers are valid for 24 months from the date of issue stated on the voucher, unless a different validity period is specified.
After the expiry of the validity period, there is generally no entitlement to redeem the voucher or receive a cash refund of its value.
In the event of loss or theft of a voucher, Die Stilkonsulentin shall not be liable unless the voucher can be clearly assigned to a specific person.
11. Data Protection
Personal data is processed in accordance with the Privacy Policy published on the website.
The Privacy Policy forms part of the information governing the handling of personal data but does not form part of these GTC.
12. Confidentiality
Die Stilkonsulentin shall treat personal information disclosed in the course of a consultation as confidential.
The customer likewise undertakes not to disclose to third parties, without consent, any confidential information concerning Die Stilkonsulentin that becomes known in the course of the collaboration.
13. Liability
Die Stilkonsulentin provides all consulting services professionally and with the utmost care. However, no specific aesthetic, personal or financial outcome can be guaranteed, as the impact and implementation of the consultation depend on individual circumstances, personal preferences and the customer's own decisions.
To the extent permitted by law, Die Stilkonsulentin shall only be liable for damage caused by wilful intent or gross negligence.
To the extent permitted by law, no guarantee is given for the continuous availability, accuracy or currency of the website or of the booking platforms and external services used.
14. Copyright
All content provided on the website and in connection with the services, in particular texts, concepts, documents, images, graphics and other materials, is protected by copyright unless expressly stated otherwise.
Any reproduction, distribution, publication or commercial use of such content is prohibited without the prior written consent of Die Stilkonsulentin.
Individually prepared consulting materials may only be used by the customer for personal purposes.
15. Force Majeure
If a service cannot temporarily be provided due to circumstances beyond the control of Die Stilkonsulentin, in particular due to natural events, official orders, technical disruptions or other cases of force majeure, the appointment shall be rescheduled where possible.
In such cases, any further claims shall only exist to the extent required by mandatory statutory provisions.
16. Applicable Law
All contractual relationships between Die Stilkonsulentin and the customer shall be governed by Swiss law.
Mandatory statutory provisions, in particular those protecting consumers, shall remain reserved.
17. Place of Jurisdiction
The courts with jurisdiction under applicable law shall have jurisdiction over disputes arising from or in connection with the contractual relationship.
To the extent permitted by law, the place of jurisdiction shall be at the registered office of Die Stilkonsulentin in Männedorf, Switzerland.
18. Amendments to the GTC
Die Stilkonsulentin may amend these GTC if its services, business processes or legal framework change.
For contracts that have already been concluded, the version of the GTC valid at the time the contract was concluded shall generally apply.
